Terms of Service
By scheduling an appointment for service by phone or online, you hereby authorize Cat 5 Plumbing Services LLC (“Cat 5 Plumbing”) and its employees, agents, representatives, and contractors (“Team Members”) to access your property to perform the requested plumbing services. You represent and warrant that you are the property owner, tenant, or otherwise authorized person with full authority to request and approve the described services and to authorize Cat 5 Plumbing Team Members to enter the property and perform work.
Payment; Credit. You understand and agree that payment is due at the time services are rendered. Cat 5 Plumbing accepts the payment methods disclosed at the time of service. No credit, deferred payment, or billing arrangements are provided or implied unless prior written approval is granted by an authorized representative of Cat 5 Plumbing. Credit accounts, where extended, are available only to legally organized businesses, subject to credit approval and limited to a net thirty (30) day billing cycle. Cat 5 Plumbing reserves the right, in its sole discretion, to deny credit to any person or entity for any lawful reason.
Workmanship and Material Warranty. Cat 5 Plumbing warrants that labor performed by its Team Members shall be free from defects in workmanship for a period of six (6) months from the date of service. Materials supplied and installed by Cat 5 Plumbing during the repair or installation are warranted for the same six (6) month period, subject to the limitations below. Manufacturer warranties for products provided by Cat 5 Plumbing may extend beyond the six (6) month workmanship/material warranty; such manufacturer warranties are separate and distinct, and any claims thereunder are subject to the manufacturer’s terms and conditions.
Post-Warranty Replacement Labor. If a part supplied by Cat 5 Plumbing is later determined to be defective and is covered under the manufacturer’s warranty after the six (6) month period has expired, Cat 5 Plumbing will use commercially reasonable efforts to facilitate replacement of the defective part in accordance with the manufacturer’s warranty. You shall be responsible for any labor, service, or other charges incurred to install replacement parts outside the six (6) month workmanship/material warranty period unless Cat 5 Plumbing agrees otherwise in writing.
Exclusions. No warranty (express or implied), whether for labor or materials, shall apply to defects, failures, or damage caused by misuse, abuse, neglect, failure to follow manufacturer’s instructions, improper maintenance, accidental damage, alteration by parties other than Cat 5 Plumbing, acts of God, or gross negligence. Cat 5 Plumbing disclaims all implied warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose, except as otherwise required by applicable law.
Customer-Supplied Materials. Cat 5 Plumbing provides no warranty, express or implied, for any product, component, or material supplied by the customer for installation by Cat 5 Plumbing Team Members. The customer assumes all risk and responsibility for the suitability, condition, performance, and warranty coverage of customer-supplied items.
Cat 5 Plumbing Services LLC — Materials and Warranty Terms
Scope of Sales Cat 5 Plumbing Services LLC ("Company") does not sell individual plumbing products or materials to the general public as standalone retail items. Materials provided by the Company are supplied solely as necessary components for the performance of a plumbing repair, installation, or maintenance service performed by the Company’s authorized technicians.
Material Costs Any material costs charged to the customer represent the cost of items that are required for a Company technician to complete the contracted plumbing repair, installation, or maintenance work. Material costs do not constitute a retail sale of individual products for separate ownership or use outside the scope of the performed service.
Limited Warranty — Six Month Coverage a. Warranty Period: The Company warrants that any item provided and installed by the Company in connection with a plumbing service will be free from defects in material and workmanship for a period of six (6) months from the date of installation (the "Warranty Period"), subject to the terms and exclusions set forth herein.
b. Remedy: If an item provided and installed by the Company fails within the Warranty Period, the Company will, at its option, replace the failed item with a product of equal value and comparable performance rating. The Company’s obligation under this warranty is limited to the cost of the replacement item and associated labor and shipping charges, if applicable.
c. Labor and Shipping: The Company shall be responsible for reasonable labor costs and shipping costs incurred in connection with the replacement of a failed item covered by this warranty.
Exclusions and Limitations a. This warranty applies only to items provided and installed by the Company and does not apply to products or materials supplied by the customer or purchased independently by the customer.
b. This warranty does not cover failures caused by misuse, abuse, improper installation by third parties, alterations, lack of maintenance, exposure to unusual or corrosive environments, acts of God, or any condition outside the Company’s control.
c. This warranty does not cover consequential, incidental, or special damages, including but not limited to loss of use, inconvenience, or property damage, except where such limitations are prohibited by applicable law.
Claim Procedure To make a warranty claim, the customer must notify the Company in writing or by phone within a reasonable time after discovery of the defect and within the Warranty Period. The customer must provide proof of service and installation by the Company, including date of service and description of the failed item.
Transferability This limited warranty is extended only to the original purchaser for services rendered by the Company and is not transferable to subsequent owners except as required by applicable law.
Governing Law These terms shall be governed by and construed in accordance with the laws of the state in which the service was performed, without regard to conflict of law principles.
Entire Agreement These terms constitute the entire agreement between the parties regarding materials and the limited warranty and supersede all prior or contemporaneous understandings, agreements, or representations, whether written or oral, relating to the subject matter hereof.

Drain Cleaning Warranty; Limitations. Cleared or cleaned drain lines are warranted against reoccurrence of the same stoppage for six (6) months from the service date for residential customers and ninety (90) days from the service date for commercial customers. This drain-cleaning warranty does not cover (and is voided by) damage to piping, collapsed or falling pipe sections, root intrusion, or other conditions that require pipe repair, replacement, relining, or excavation. If such conditions are discovered, they shall be excluded from the drain-cleaning warranty and billed separately.
Right to Refuse Service. Cat 5 Plumbing reserves the right to refuse service to any person, property, or for any requested work for any lawful reason.
Limitation of Liability. To the fullest extent permitted by law, Cat 5 Plumbing’s liability for any claim arising out of or related to the services provided shall be limited to the amount actually paid by the customer to Cat 5 Plumbing for the specific service that gave rise to the claim. In no event shall Cat 5 Plumbing be liable for incidental, consequential, punitive, or special damages.
Governing Law; Venue. These terms shall be governed by and construed in accordance with the laws of the state of Florida without regard to conflict-of-law rules. Any legal action or proceeding arising under or relating to these terms shall be brought exclusively in the state or federal courts located in the applicable county in Northwest Florida in which Cat 5 Plumbing maintains its principal place of business, and you consent to the personal jurisdiction of such courts.
Severability. If any provision of these terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Entire Agreement; Amendments. These terms constitute the entire agreement between you and Cat 5 Plumbing with respect to the subject matter herein and supersede all prior or If evidence establishes gross negligence, intentional or accidental damage, or use of a product in a manner inconsistent with the manufacturer's written recommendations, the Owner shall be liable for all costs of labor and materials necessary to repair or replace the affected product(s). The Owner’s liability shall include, but not be limited to, charges for removal and disposal of damaged items, procurement of replacement parts or products, labor for installation, and any ancillary costs reasonably incurred by Cat 5 Plumbing Services LLC in restoring the product(s) to proper working condition.
The Owner shall indemnify, defend, and hold harmless Cat 5 Plumbing Services LLC, its officers, employees, agents, and contractors from and against any and all claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to such negligence, intentional or accidental damage, or improper use of products. This indemnity obligation shall apply irrespective of whether the claim is asserted by the Owner or a third party.
Cat 5 Plumbing Services LLC shall provide the Owner with written notice of any such damage and an itemized estimate of the costs to repair or replace the damaged product(s). The Owner shall remit payment for the full amount of such costs within thirty (30) days of receipt of the invoice unless otherwise agreed in writing. If payment is not received within the specified period, Cat 5 Plumbing Services LLC shall have the right to pursue all available legal and equitable remedies, including but not limited to collection actions, lien rights to the extent permitted by applicable law, and recovery of all collection costs, interest on the unpaid balance at the maximum rate allowed by law, and attorneys’ fees.
Nothing in this clause shall be construed to limit Cat 5 Plumbing Services LLC’s remedies for fraud, willful misconduct, or other acts that give rise to liability under applicable law. This provision shall survive termination or completion of the services provided by Cat 5 Plumbing Services LLC.
